2. SERVICE DESCRIPTION AND SCOPE
2.1 Our Services
DW provides luggage storage, transportation, and delivery services including:
- Luggage pickup from designated locations (airports, train stations, ports, hotels, private addresses)
- Secure storage in our certified facilities
- Luggage delivery to specified destinations
- Quick booking system for immediate reservations
- Multi-step booking platform with real-time pricing
2.2 Service Areas
Our services operate primarily in Barcelona and surrounding areas, with specific coverage for:
- Barcelona Airport (BCN)
- Barcelona Port (cruise terminals and ferry stations)
- Barcelona train stations (Sants, França, etc.)
- Hotels and private addresses within our service area
- Tourist accommodation facilities
2.3 Booking System
Services can be booked through:
- Our online reservation platform at bagsandgo.com
- Quick booking widget for immediate reservations
- Phone reservations during business hours
3. ACCEPTANCE OF TERMS
3.1 Agreement
By using our booking system, making a reservation, or utilizing our services, you agree to these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.
3.2 Capacity
You must be at least 18 years old or have parental/guardian consent to use our services. By booking, you confirm you have the legal capacity to enter into this agreement.
3.3 Accurate Information
You guarantee that all information provided during booking is accurate, complete, and truthful. Any errors in delivery addresses or contact information that result in additional costs will be borne by the customer.
4. SERVICE CONDITIONS AND LIMITATIONS
4.1 Independence
DW is an independent service provider and is not affiliated with:
- Cruise ship companies
- Airport terminal operators
- Train station management
- Hotel chains or accommodations
- Travel agencies or tour operators
However, we may enter into specific agreements with such entities when mutually beneficial.
4.2 Right to Refuse Service
DW reserves the right to refuse service for luggage that is:
- Dangerous, unsafe, or inappropriate
- Exceeding weight or dimension limits
- Fragile beyond reasonable handling
- Of organic or perishable nature
- Prohibited by Spanish law or regulations
- Improperly secured or locked
4.3 Security Inspections
DW reserves the right to:
- Request official inspection or X-ray of any luggage
- Report suspicious items to customs authorities
- Provide customer data to authorities when legally required
- Attend as witness during official inspections
4.4 Luggage Security Requirements
- All luggage must be properly closed with a padlock or secure lock
- DW accepts no responsibility for improperly secured luggage
- Luggage with broken locks or zippers will not be accepted
- Customers are responsible for ensuring luggage integrity before handover
5. CUSTOMER RESPONSIBILITIES
5.1 Prohibited Items
Customers are solely responsible for:
- Money, checkbooks, credit cards
- Jewelry and precious metals
- Electronic devices (phones, cameras, computers)
- Medicines and medical equipment
- Glasses, watches, and personal accessories
- Tobacco products and valuable items
- Works of art and collectibles
- Any illegal or prohibited substances
5.2 Content Declaration
- DW is not aware of luggage contents
- Customers must not include dangerous or illegal items
- Truthful description of contents is required for shipping services
- Customs declaration is customer’s responsibility
5.3 Identification Requirements
- Valid ID or passport required for pickup and delivery
- Original booking confirmation must be presented
- Customer must sign contract upon delivery to confirm satisfaction
6. PRICING AND PAYMENT
6.1 Service Fees
- Prices are displayed in EUR and include applicable taxes
- Pricing is based on number of pieces, service type, and duration
- Real-time pricing is provided through our booking system
- Additional fees may apply for special services or locations
6.2 Payment Methods
- Secure online payment through our WooCommerce integration
- Credit/debit cards with 3DSecure verification
- Payment is required at time of booking
- All transactions are processed on secure SSL-encrypted servers
6.3 Currency and Taxes
- All prices are in Euros (EUR)
- VAT and applicable taxes are included in displayed prices
- International customers may be subject to additional customs duties
7. PICKUP AND DELIVERY
7.1 Pickup Service
- Minimum 24-hour advance booking required (3 hours for cruise passengers)
- Specific time windows will be provided during booking
- Customer or authorized representative must be present
- Luggage must be ready and properly secured
7.2 Delivery Service
- Standard delivery within 72 hours of pickup
- Up to 3 delivery attempts will be made
- Delivery notifications will be provided
- Customer or authorized recipient must be available
7.3 Failed Delivery
If delivery cannot be completed after 3 attempts:
- Luggage will be stored in our warehouse
- Storage fees of €10 per piece per day apply
- Maximum storage period of 5 days for failed deliveries
- Customer bears all additional costs
8. UNCLAIMED AND ABANDONED LUGGAGE
8.1 Unclaimed Luggage
Luggage not collected by 23:00 on the agreed day will be considered unclaimed:
- Storage fee of €10 per piece applies
- Customer must pay all accrued fees upon collection
- DW has no obligation to contact customers about unclaimed items
8.2 Abandoned Luggage
Luggage is considered abandoned if:
- Not collected within 12 hours of agreed time
- Customer has not contacted DW within 12 hours
- No response to DW’s contact attempts
8.3 Storage and Disposal
For abandoned luggage:
- Initial 72-hour grace period at Port of Barcelona facility
- DW will attempt to contact customer during this period
- Transfer to warehouse storage for maximum 30 days
- Storage fees of €10 per piece per day apply
- After 30 days, luggage may be disposed of at DW’s discretion
9. INSURANCE AND LIABILITY
9.1 Standard Coverage
- Maximum compensation: €250 per piece for total loss
- Coverage applies only to DW’s proven negligence
- Structural damage coverage up to €120 per piece
- Proof of purchase required for damage claims
9.2 Exclusions
Insurance does not cover:
- Pull-up handles, straps, or wheels
- Contents of luggage (see Section 5.1)
- Damage due to improper packing
- Pre-existing damage or wear
- Consequential or indirect damages
9.3 Claims Process
- Claims must be submitted before luggage collection
- Photo evidence may be required
- Claims will be processed within 30 days
- Compensation is limited to actual value, maximum as stated above
10. CANCELLATION AND REFUND POLICY
10.1 Cancellation Terms
- More than 7 days before service: Full refund (100%)
- 4-7 days before service: 50% refund
- Less than 3 days before service: No refund (100% charge)
10.2 Refund Process
- Refunds processed to original payment method
- Processing time: 5-10 business days
- Refund fees may apply depending on payment provider
10.3 Service Modifications
- Changes subject to availability and may incur additional charges
- Modifications must be requested at least 24 hours in advance
- Contact customer service for modification requests
11. DATA PROTECTION AND PRIVACY
11.1 GDPR Compliance

This contract is governed by Spanish law, specifically:

- Law 29/2003 reform of LOTT regarding valuations
- Barcelona Arbitration Court jurisdiction
- Commercial Commission rules
14.2 Dispute Resolution
- Primary resolution through customer service
- Mediation services available upon request
- Barcelona courts have exclusive jurisdiction
- Customer waives any other jurisdictional claims
14.3 Language
- These terms are originally drafted in English
- Spanish translation available upon request
- In case of discrepancy, English version prevails
- Local language requirements as per applicable law

If any provision of these terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.
16.3 Entire Agreement
These Terms and Conditions constitute the complete agreement between customer and DW, superseding all prior agreements or understandings.
